The Binaural operates this service, including the website at thebinaural.com and The Binaural mobile app. This Privacy Policy explains what information we collect, how we use it, how we share it, and the rights and choices you have. By using the service, you agree to this policy.

1. Information We Collect

We collect the following categories of information when you use the service:

• Account information: When you register, we collect your email address and an encrypted password. Guest users are assigned a temporary anonymous identifier. If you choose to sign in with a third-party sign-in provider, we receive basic profile details such as your name and email address from that provider.
• Usage and session data: Records of your sessions, including session type, frequencies, duration, effectiveness ratings, and any notes you add, along with your preferences and in-app activity. We use this to personalize your experience.
• Device information: Basic device details such as device type, operating system, browser, and screen size, used for compatibility and to improve the experience.
• Cookies and local storage: We use session cookies to keep you signed in and local storage to save your preferences, such as theme and audio settings.

2. How We Use Your Information

3. AI and Machine-Learning Processing

To personalize your sessions, limited session metadata and preferences (not your name or contact details) may be processed by AI and machine-learning providers acting on our behalf. This data is used only to generate recommendations and is not sold. If AI processing is unavailable, the service falls back to non-AI defaults so your experience is never interrupted.

4. Audio Processing

Binaural audio is generated on your device. We do not record audio, and the service does not access your microphone.

5. How We Share Information

We do not sell your personal information. We share limited information with service providers who process it on our behalf, described by category rather than by name:

• Hosting and infrastructure providers, who store and serve the service.
• AI and machine-learning providers, who help generate personalized recommendations.
• Analytics and product-measurement providers, who help us understand and improve usage.
• Error-monitoring providers, who help us detect and fix technical problems.
• Email-delivery providers, who send transactional and service messages.
• Payment processors, only if you choose to make a payment for any paid feature. We do not store full payment card numbers.
• Authentication and sign-in providers, if you choose to sign in with a third-party service.

We may also disclose information when required by law, to protect our rights and the safety of users, or in connection with a merger, acquisition, or sale of assets. Each provider is permitted to use your information only to perform services for us.

6. Cookies and Analytics

We use strictly necessary session cookies and local storage to operate the service, keep you signed in, and remember your preferences. These are always on. We also use non-essential analytics and error-monitoring technologies that stay off until you accept them:

• Product analytics, which record page views and in-app interactions to help us understand and improve usage. This can include session replay, a recording of on-screen interactions (with sensitive inputs such as passwords masked), used to diagnose usability issues.

We retain your account data and session history for as long as your account is active. Guest accounts and their data may be automatically deleted after 90 days of inactivity. If you delete your account, we remove your personal data within 30 days, except where we are required by law to retain it. Aggregated or anonymized data that no longer identifies you may be retained for analytics.

You have the right to know what we collect, to request access and deletion, to correct inaccurate information, and to opt out of the sale or sharing of personal information. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. 10. European Economic Area and UK Rights

If you are in the European Economic Area, the United Kingdom, or Switzerland, The Binaural is the controller of your personal data. We rely on the following lawful bases: performance of a contract, to provide the service you request; our legitimate interests, to secure, measure, and improve the service; your consent, for optional analytics and similar technologies; and compliance with legal obligations. You have the right to access, rectify, erase, restrict, and port your data, to object to processing, and to withdraw consent at any time. You also have the right to lodge a complaint with your local supervisory authority. Where we transfer data internationally, we use appropriate safeguards.

11. International Data Transfers

Your data may be processed in the United States and other countries where our service providers operate. Where required, we put appropriate safeguards in place for these transfers.

12. Children's Privacy

The service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, contact us and we will delete it promptly.

13. Data Security

We use reasonable security measures, including encrypted transmission over HTTPS, hashed passwords, and access controls. No method of electronic storage or transmission is completely secure, so we cannot guarantee absolute security.
